So if you come across a body lying face down with a knife in the back, it's not a murder because no one has been charged?
What you do is round up the persons of interest, interrogate them and eventually arrest them. If they admit to the murder, end of story. If they dont and are charged, then they are tried and thrown in jail for attempted, murder 1, 2 or 3. They arnt let go because they are guilty and the murdered person, is still dead.
